- In the General Conditions of Use (CGU), in the event of disagreement or conflict, it is generally necessary to specify the dispute resolution steps. Here is a proposal including the common options:
- In case of conflict:
In the event of disagreement or conflict between the parties regarding the interpretation or execution of these General Conditions of Use, the parties agree to use the following steps to resolve their dispute:
- Conciliation: The parties will endeavor to resolve their dispute informally and amicably through conciliation.
- Mediation: If conciliation fails to resolve the dispute, then the parties may decide to resort to mediation, a process in which a neutral mediator attempts to facilitate an agreement between the parties.
- Arbitration: If mediation does not result in a satisfactory resolution of the dispute, the parties agree to submit the dispute to binding arbitration in accordance with the arbitration rules in effect at the time of the dispute.
- Litigation: As a last resort, if none of the above steps resolves the dispute, the parties reserve the right to resort to the competent courts. Commercial disputes can be handled in small claims court. However, it also depends on the amount involved and the specific nature of the dispute. For more complex cases or larger amounts, ordinary civil courts could have jurisdiction. It is recommended that you consult an attorney for legal advice specific to your situation.
